WHAT MAKES YOU A GOOD COUNSELLOR?
I personally have attended many sessions and competitions on client counselling so what I feel is that there are many small aspects and points which are important and are to be taken care of from the attorneys perspective but are often overlooked. Maybe because they are too small or common to be take care of in our normal life’s but as attorney they play a very important role in handlling the client .attorney needs to handel and deal with clients of different temprament, emotional capabilities and strength, hence they need to acquire a set of skills to do so. These skills are known as counselling skills.
What makes you a good counsellor ?
- The client needs to be assured that the conversation between them will remain confidential. As this makes tt he client feel more assured and comfortable and then there are more chances of him delivering you the true facts.
2.second point is you need to make the client feel comfortable in the atmosphere by asking him/her water and starting with short random question, so that the client feels connected. - clients are mostly in a state of either depression or are tensed ,from such clients gathering information is not easy. As such clients are not open to conversations or are over enthusastic. In both the situation it is the work of attorney to make the client comfortable and make him speak and in the later situation calm him/her down and aks her question to get more clarity.
- I personally feel that this point is the most important one because if you make the client comfortable and the client os even open to discussions but if the facts stated are incomplete then there is no clarity. Hence the lawyer should stress on the point that the client tells them the whole thing and leave it to the attorney to figure out which facts are important because a fact may not be important according to the client but can be very useful for the case.
- The attorney should always communicate in a laymans language with the client as the client would not be familiar with legal terminology and use of legal terminology may create a barrier between the attorney and the client.
6.lawyers needs to be patient with the client because many times your client may not listen to you or will not be willing to understand your point. So, a attorneys you need to stop them and aks them to make the fact more clear or explain it in detail and later cross check it. - Some attorneys suggest that the fees negotiation should be done in the starting of the first meeting but my personal views are that the fees negotitaons should be done at the end of the first session or in the starting of the next session. Because is the client feels your advice is helpful the client will for sure revert to you. Whereas, if to talk about the fees st the stating of your first meeting then it may make your client a bit uncomfortable and create a barrier between you and your client.
- It is very obvious that client forgets some facts while dictating the whole scenario to the attorney so the attorney should ask the client if after going home the client remembers some points which he missed in the session he/ahe needs to note them down or mail them to you.
- Attorney handles many cases in a single time span so he himself should also note the facts down so that he do not mixies the facts of two cases or misses an important fact or incident.
